Terms governing use of Pow-R-Wall's website, product purchases, and services. Read before submitting forms or ordering products.

1. Acceptance of terms

By accessing or using powrwall.com (the "Website") or purchasing Pow-R-Wall products or services, you agree to be bound by these Terms of Service. If you do not agree, do not use the Website or our products.

2. Description of services

Pow-R-Wall is a brand of Resilient Building Products within Second Mile Companies. We manufacture and distribute the Pow-R-Wall vertical insulated concrete form (ICF) system, including foam panels, furring assemblies, retainer clips, base angles, and accessories. We also provide engineering, installation training, and ongoing customer support.

3. Eligibility

You must be at least 18 years old to submit forms, place orders, or otherwise interact with our website in a transactional capacity.

4. Account creation

If you create an account on our website, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

5. Product orders and pricing

Pow-R-Wall product orders are subject to acceptance, availability, and project-specific engineering review. Prices are quoted on a per-project basis and are valid for the period specified in the quote.

Orders are filled through our regional distributor network. Shipping, delivery, and payment terms are specified in the distributor's order acceptance.

Custom-cut panels are non-returnable. Standard, unused panels may be returned to the distributor within 30 days for credit subject to a restocking fee.

6. Engineering documentation

Project-specific engineering documentation provided with Pow-R-Wall orders is stamped for the specific project conditions described in the order. The engineering documentation is the property of Resilient Building Products and is provided under license for use on the specified project only.

Use of Pow-R-Wall engineering documentation for projects other than those specified, or modification of the documentation, voids the engineering stamp and may result in unsafe construction.

7. Installation responsibility

While Pow-R-Wall provides installation training, technical support, and engineering documentation, the actual installation is the responsibility of the contractor, builder, or homeowner-installer. Pow-R-Wall does not warrant installation quality. We recommend completing the virtual installation training session before installing your first Pow-R-Wall project.

8. Warranty

Pow-R-Wall products are warranted to be free from defects in materials and manufacturing under normal use for 5 years from the date of delivery. The warranty does not cover damage caused by improper installation, modifications to the product, or use in applications not approved by Pow-R-Wall engineering.

9. Limitation of liability

To the maximum extent permitted by law, Pow-R-Wall, Resilient Building Products, Second Mile Companies, and our affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services.

Our total liability for any claim related to the products or services is limited to the amount you paid for the specific product or service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Pow-R-Wall, Resilient Building Products, Second Mile Companies, and our affiliates from any claim, damage, loss, or expense arising from your use of our products or services, your violation of these Terms, or your violation of any third-party rights.

11. Intellectual property

The Pow-R-Wall name, logo, and brand assets are trademarks of Resilient Building Products. The Pow-R-Wall vertical-panel ICF system, including the Fail-Safe Locking Grid design, is protected by U.S. Patent #8,371,082 and Canadian Patent #2,621,021. Engineering documentation, technical drawings, and specification templates are copyrighted.

You may not use Pow-R-Wall trademarks, copyrighted materials, or patented technology without our written permission.

12. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict of laws principles. Any disputes arising from these Terms or use of our products will be resolved in the state and federal courts of Missouri.

13. Changes to these Terms

We may update these Terms of Service from time to time. We will post updates on this page with a new effective date. Your continued use of our website or services after we post changes constitutes acceptance of the updated Terms.
